Terms & Conditions

These Terms & Conditions (“Terms”) govern the use of www.elephant7.co.in (the “Website”), the Elephant-7 mobile applications (the “App”), and all purchases from Elephant-7 Engine Oil (“Elephant-7”, “we”, “our”, “us”). By accessing the Website/App or placing an order, you agree to these Terms.
1) Business Model & Brand Policy
We manufacture and sell only our own brand, Elephant-7.
We also manufacture private-label/custom-brand products as per customer requirements (subject to agreement and MOQs).
We do not sell, promote, or list any third-party brands on our Website/App.
2) Definitions
Distributor / Dealer / Wholesaler: Business entities purchasing for resale in their respective channels.
Retailer: A business entity (shop/firm/company) purchasing for resale to end consumers. Retailer does not mean an individual consumer.
Customer-Brand / Private-Label: Products we manufacture to specifications and brand assets provided by the customer.
3) Sales Channels & Eligible Buyers
Physical/Offline Sales: We sell only to Distributors, Dealers, and Wholesalers.
Online Sales (Website/App): We sell to Distributors, Dealers, Wholesalers, and Retailers.
No Direct-to-Consumer Sales: We do not sell directly to individual end users unless expressly announced by Elephant-7 in writing.
4) Account Registration, KYC & Approvals
Online buying requires account creation. We may request KYC (e.g., GSTIN, trade license, PAN, FSSAI not applicable, etc.).
We reserve the right to approve/deny/suspend accounts at our discretion.
5) Ordering, Pricing & Payment
Orders are offers to buy and are accepted when we issue a written/electronic Order Confirmation.
Prices, taxes, duties, freight and any promotions will be shown at checkout; errors may be corrected.
Payment terms: Prepaid unless a separate credit arrangement exists. Late payments may attract charges and order holds.
MOQs and packaging configurations may apply, especially for private-label orders.
6) Custom Branding / Private-Label
Subject to separate agreement, minimum order quantities, and lead times.
Customer is solely responsible for legality and ownership of supplied brand name, logo, artwork, and packaging claims.
Elephant-7 is not liable for IP disputes or regulatory issues arising from customer-provided content.
Tooling/plates/artwork charges (if any) are non-refundable.
7) Shipping, Delivery & Risk
Dispatch timelines depend on order size, stock, and logistics. Estimated dates are indicative.
Risk of loss/damage passes to buyer upon handover to carrier. Insurance is the buyer’s option unless agreed otherwise.
Delays due to carrier issues, strikes, natural events, or force majeure are not our liability.
8) Inspection, Returns & Claims
Inspect goods on delivery. For damaged/short/incorrect items, raise a claim within 7 days with photos, AWB, and invoice.
Returns are accepted only for verified manufacturing defects, transit damage, or supply errors.
Opened/used/tampered packs are not eligible unless a manufacturing defect is proven.
Remedies are limited to replacement, credit note, or refund at our discretion.
9) Product Use, Storage & Warranty
Use products strictly as per specifications and recommended applications.
Store in sealed condition, away from contamination, moisture, and extreme temperatures.
We provide a limited warranty against manufacturing defects up to the printed shelf-life/expiry.
We disclaim all other warranties to the extent permitted by law, including fitness for a particular purpose where incorrect selection/usage or poor storage is involved.
10) Resale & Brand Integrity
Buyers must sell only authentic, sealed Elephant-7 packs (or their approved private-label packs).
Decanting, refilling, relabeling, or altering product/packaging is strictly prohibited.
No listing or promotion under unrelated third-party brands via our Website/App.
11) Intellectual Property
Elephant-7 name, logos, designs, product names, packaging, and Website/App content are our IP.
No license is granted to reproduce, modify, or use our IP without written permission.
12) Website/App Use
Do not misuse the Website/App (e.g., scraping, attempting to breach security, injecting malware, misleading listings).
We may modify, suspend, or terminate access for violations.
All content is provided on an “as-is” basis; we may update specs, pack sizes, and availability without notice.
13) Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim is limited to the invoice value of the goods giving rise to the claim.
We are not liable for indirect, incidental, punitive, or consequential losses (e.g., business interruption, lost profits).
14) Compliance
Buyers must comply with all applicable laws, including GST, labeling, storage norms, and hazardous goods handling where applicable.
15) Force Majeure
We are not liable for failures or delays caused by events beyond our reasonable control (natural disasters, acts of government, strikes, epidemics, logistics disruptions, etc.).
16) Changes to Terms
We may update these Terms at any time. Continued use of the Website/App or placing orders after changes means you accept the updated Terms.
17) Governing Law & Jurisdiction
These Terms are governed by the laws of West Bengal, India.
Courts at North 24 Parganas, West Bengal will have exclusive jurisdiction.
